Definitions
The <
Software Product > consists of computer executable programs,
databases and documentations - written materials - referred as Quizoodd
products. The < Software
Product > is licensed ( not sold ) to YOU.
The
owner of < Software Product > is the author : < Dinu MIHAIL - VADUVA
> which has all proprietary rights in the < Software Product >. The < Software
Product > is protected by International Copyright Law. YOU are licensed
to use this < Software Product > on the following terms and
conditions :
License
The
< Software Product > is designed to create public (free) or
commercial products with a tree support structure that shows instructional
documents with quizzes embedded to help personal education or training
activities. < Quizoodd - Pro > executable application has two functions :
TRIAL and PRO. For TRIAL version you need to register utilization with your
name, email and your favourite USB
storage device. Please use the file LICENSE_TRIAL.
accdb to complete registration for TRIAL version. Registration for TRIAL
version of < Quizoodd Pro > is free. For PRO version ( commercial ) of
< Quizoodd Pro > you need to register to
receive an invoice related with your order / request. For PRO version (
commercial ) of < Quizoodd Pro > you need to register utilization with
your name, email, full address and your favourite USB storage device. Please
use the file LICENSE_PRO.accdb to complete registration for PRO version.
Any software license key for < Software Product > is correlated
only with the informations required at the moment of registration. The format
used for any software license key is ASCII ( TXT file that could be read with
WORDPAD ) to assure YOU that everything is conducted in a transparently manner. Any software license
key will be delivered assuming that YOU send a valid registration order file
created by the < Software Product >. Any software license key for
< Quizoodd Pro > PRO version or any commercial Quizoodd ACCDB product
will be delivered by email only after the client finish the payment for it. Only
the owner of < Software Product > has the right to create license
software key for the following products : LICENSE_TRIAL.accdb and LICENSE_PRO.accdb
and, as a consequence, those names are reserved and not available to be
used for any other Quizoodd ACCDB products. The scope of < Quizoodd - Pro
> application is to create unlimited number of Quizoodd products - public ( free ),
commercial - with ACCDB file format or HTML packages. Any Quizoodd ACCDB product ( free or
commercial ) is tagged with your details : name, email, ID for your favourite
USB storage device used at the registration time. The user of < Quizoodd -
Pro > are the only one responsible / liable about the content inserted into
his QUIZOODD ACCDB / DBQ / HTML products free or commercial. The user of <
Quizoodd Pro > ( TRIAL or PRO ) could load and play only his own Quizoodd
ACCDB products and cannot use < Quizoodd Pro > to load and play any
public (free) or commercial Quizoodd ACCDB products created by someone else.
The only format that could be shared between users of < Quizoodd Pro >
TRIAL or PRO version is the DBQ format. The user of < Quizoodd - Pro
> TRIAL version could creates any number of license software key for his own
Quizoodd ACCDB potentially commercial products to test the functionality of the
< Quizoodd - VIEWER > application related with them. The user of <
Quizoodd - Pro > PRO version could
creates any number of license software key
for his own Quizoodd ACCDB commercial products related with the
utilization of such products by his clients with the help of the application
< Quizoodd VIEWER >. Only the user of PRO version of < Quizoodd Pro
> has the right to use his commercial Quizoodd ACCDB products for business
activity on a royalty-free basis. Any Quizoodd ACCDB product created with TRIAL
version of < Quizoodd - Pro > will
be tagged with a label that shows the TRIAL version of < Quizoodd Pro >
and, as a consequence, YOU are not entitled to sell your
Quizoodd ACCDB commercial product developed. < Quizoodd - VIEWER >
executable application is FREE to use on
a royalty-free basis. No registration is
required to use < Quizoodd VIEWER >.
< Quizoodd - VIEWER > is used to load and play any public ( free
) or commercial ACCDB Quizoodd products
from any developer ( user ) of < Quizoodd PRO > who creates them. You
may run the < Software product > on any computer you want but one at a time with your personal
and favourite USB storage device used at the moment of registration related to
the TRIAL or PRO version of < Quizoodd Pro >. If you remove the favourite
USB storage device when the < Quizoodd Pro > runs then the executable
application stops ( exits from RAM memory ) and you need to reload it with the help of your
favourite USB storage device. If you use the < Quizoodd VIEWER > and a
commercial Quizoodd ACCDB product is already loaded into it then if you remove
the favourite USB storage device the
executable application < Quizoodd VIEWER > stops ( exits from RAM memory ). This behaviour,
related to USB storage device, permits utilization of < Software Product
> on any computer you want but one at
a time. < Quizoodd VIEWER > is minimized ( not closed ) , at the runtime
moment, at any time you select and run any other application from your
operating system ( screen-shot not
allowed ). The < Software Product > is designed to be used only to
a local HDD computer ( not remote or network ). The Quizoodd product with DBQ
or ACCDB format is designed to be used in a exclusive manner ( not shared ).
Every new USB storage device requires a new license for < Software
Product >. It is recommended to keep the same USB storage device for licensing products
from < Software product >.
You are granted non-exclusive right to install and use the < Software
Product > You may copy the < Software Product > for
archival purposes . You must keep the original
Software Product's proprietary notices in unaltered form in all
documents created or installed by the < Software Product >. Backup < Software Product
> to be sure that you could execute restoring.
Restrictions
You may not permit others to use your
licensed commercial Quizoodd ACCDB products from < Software Product >. YOU, and
others, are not authorized to modify, disassemble or reverse engineering the
< Software Product > . YOU, and others, are not authorized to
remove or obscure any notices, labels, trademarks or proprietary rights
informations in all files created or installed by the < Software Product >. You may
not transfer, rent, sub-license or otherwise any rights derived from your
personal licensed software key ( TRIAL or PRO ) on the < Software Product
> to others.
Exclusion of
Product Warranty
Vendor
does not warrant the contents of the < Software Product > or that it will
be error free. The < Software Product
> is furnished 'AS IS' and without warranty as to the performance or
results YOU may obtain by using the < Software Product >. The entire risk
as to the results and performance of the Software Product is assumed by YOU.
There are no other warranties, representations or guarantees of any kind
whatever regarding < Software Product >
No consequential
loss
In no
event will Vendor or its third party suppliers be liable to YOU for lost
profits / savings or damages arising out of the possession or use of the <
Software Product >
Permits
You
are exclusively responsible for obtaining any approvals for YOU to export,
import, possess, install use or operate the < Software Product > in a
territory
Exclusions
The
< Software Product > is not designed to be used in any domain, on the
forefront of technology, similar with importance of flight navigation / medical
device or nuclear activities. If YOU are using the < Software Product >
for previous case YOU agree that, the Vendor is not liable, in whole or in
part, for any claims or damages arising from such use
Termination
Your
license is terminated if you fail to keep possession, or deteriorate, your
favourite USB storage device used at the moment of the registration related
with the < Quizoodd Pro > TRIAL,
PRO version or any commercial Quizoodd
ACCDB product loaded into < Quizoodd VIEWER >. Special commercial
terms ( insurance ) could be adopted
supplementary to provide a
guarantee against such events.This insurance must be adopted only at the moment
of registration for PRO version of <
Quizoodd Pro > or a commercial ACCDB Quizoodd product. This Agreement will
terminate if YOU do not comply with any terms or conditions of this agreement
Return/Refund
POLICY
TRIAL
version for Quizoodd Pro has the same
functionality with PRO version.
TRIAL
version for Quizoodd Pro has unlimited
time for testing.
Registration
for Quizoodd Pro TRIAL version is free.
For this
cause all sales for Quizoodd Pro are final : no payment may be
returned or refunded.

trademark of Mirage Computer Systems GmbH.
DemoBuilder is a trademark of Tanida Inc. InstallShield
Express is a trademark of Flexera Software Limited. The furnishing of this
document does not give you any license to these (above) patents, trademarks,
copyrights, or other intellectual property. Complying with all applicable
copyright laws is the responsibility of the user. No association is intended or
should be inferred regarding any real company, organization, product, domain
name e-mail address, logo, person, place or event when you consider the content
of the < Software Product >.
Entire Agreement
This Agreement shall take precedence over any additional or conflicting
terms which may be contained in Your purchase orders or Vendor's
acknowledgement thereof.
